End User License Agreement

Please read this End User License Agreement ("Agreement") carefully before using the MyLinkLine Portal or any related services. By accessing or using the Service, you agree to be bound by this Agreement.

1. Acceptance of Terms

This Agreement is a legal contract between you ("User," "you," or "your") and MyLinkLine Communications ("Company," "we," "us," or "our") governing your use of the MyLinkLine Portal, mobile applications, device monitoring services, video streaming services, and all related software and services (collectively, the "Service").

By creating an account, accessing, or using the Service, you acknowledge that you have read, understood, and agree to be bound by this Agreement. If you do not agree, do not access or use the Service.

2. Description of Service

MyLinkLine Communications provides an integrated platform for:

  • Device Monitoring: Remote monitoring and management of IoT devices, including heartbeat tracking, status alerts, and telemetry data collection.
  • Video Streaming: Emergency and on-demand video streaming through dedicated video units, including RTMP/SRT stream management and recording.
  • User & Company Management: Multi-tenant account management with role-based access control.
  • Billing & Invoicing: Invoice management, payment processing, and financial reporting through integrated accounting systems.
  • Communication Services: Real-time chat, notifications, and support features.

3. License Grant

Subject to your compliance with this Agreement, MyLinkLine Communications grants you a limited, non-exclusive, non-transferable, revocable license to access and use the Service for your internal business purposes. This license does not include the right to:

  • Sublicense, sell, resell, or distribute the Service or any part thereof;
  • Modify, reverse engineer, decompile, or disassemble any portion of the Service;
  • Copy, reproduce, or create derivative works based on the Service;
  • Use the Service to build a competing product or service;
  • Remove, alter, or obscure any proprietary notices or labels on the Service.

4. Account Responsibilities

You are responsible for:

  • Maintaining the confidentiality of your account credentials;
  • All activities that occur under your account;
  • Ensuring that all persons who access the Service through your account are aware of and comply with this Agreement;
  • Promptly notifying us of any unauthorized use of your account or any other breach of security;
  • Providing accurate and complete information during registration and keeping your account information up to date.

We reserve the right to disable any user account at any time if, in our sole judgment, you have violated any provision of this Agreement.

5. Device and Equipment

Certain aspects of the Service require the use of MyLinkLine-approved devices and equipment. You agree to:

  • Use only authorized and approved devices with the Service;
  • Maintain devices in proper working condition;
  • Not tamper with, modify, or alter device firmware or software without written authorization;
  • Report any device malfunctions or irregularities promptly;
  • Allow device telemetry and heartbeat data to be transmitted to the Service for monitoring purposes.

6. Video Streaming and Recording

If you use the video streaming features of the Service:

  • You are responsible for complying with all applicable laws regarding video recording and surveillance in your jurisdiction;
  • You must obtain any required consent from individuals who may be recorded;
  • Video recordings may be stored on our servers for a limited period as described in our data retention policies;
  • We do not monitor the content of video streams, but reserve the right to disable streams that violate this Agreement or applicable law;
  • API keys provided for video unit access are confidential and must not be shared with unauthorized parties.

7. Acceptable Use

You agree not to use the Service to:

  • Violate any applicable local, state, national, or international law or regulation;
  • Transmit any material that is unlawful, harmful, threatening, abusive, harassing, defamatory, or otherwise objectionable;
  • Interfere with or disrupt the Service, servers, or networks connected to the Service;
  • Attempt to gain unauthorized access to any portion of the Service or any systems or networks connected to the Service;
  • Use automated means (bots, scrapers, crawlers) to access the Service without our prior written consent;
  • Overload, flood, or spam the Service with excessive requests or data;
  • Use the Service for any purpose that is fraudulent or otherwise illegal.

8. Intellectual Property

The Service, including all content, features, functionality, software, text, displays, images, and the design, selection, and arrangement thereof, is owned by MyLinkLine Communications, its licensors, or other providers and is protected by United States and international copyright, trademark, patent, trade secret, and other intellectual property laws.

The MyLinkLine name, logo, and all related names, logos, product and service names, designs, and slogans are trademarks of MyLinkLine Communications. You may not use such marks without our prior written permission.

9. Data and Privacy

Your use of the Service is also governed by our Privacy Policy, which is incorporated into this Agreement by reference. By using the Service, you consent to the collection, use, and sharing of your information as described in the Privacy Policy.

You retain ownership of any data you submit to the Service. By submitting data, you grant us a limited license to use, store, and process that data solely for the purpose of providing and improving the Service.

10. Service Availability and Modifications

We strive to ensure the Service is available at all times, but we do not guarantee uninterrupted or error-free operation. We reserve the right to:

  • Modify, suspend, or discontinue the Service (or any part thereof) at any time with or without notice;
  • Perform scheduled and emergency maintenance that may temporarily affect Service availability;
  • Update, modify, or change the features and functionality of the Service;
  • Impose limits on certain features or restrict access to parts of the Service.

We shall not be liable to you or any third party for any modification, suspension, or discontinuance of the Service.

11. Third-Party Services

The Service may integrate with or contain links to third-party services, including but not limited to payment processing, accounting systems, and communication platforms. Your use of such third-party services is subject to their respective terms and conditions. We are not responsible for the content, policies, or practices of any third-party services.

12. Fees and Payment

Certain features of the Service may require payment of fees. You agree to pay all applicable fees as described at the time of purchase or as set forth in a separate service agreement. All fees are non-refundable unless otherwise stated. We reserve the right to change our fees upon reasonable notice. Continued use of the Service after a fee change constitutes your acceptance of the new fees.

13. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.

MyLinkLine Communications does not warrant that:

  • The Service will meet your specific requirements;
  • The Service will be uninterrupted, timely, secure, or error-free;
  • The results obtained from use of the Service will be accurate or reliable;
  • Any errors in the Service will be corrected.

14. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL MYLINKLINE COMMUNICATIONS, ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, OR AFFILIATES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR IN CONNECTION WITH:

  • Your use of or inability to use the Service;
  • Any unauthorized access to or alteration of your data;
  • Any third-party conduct on the Service;
  • Any device malfunction or failure;
  • Any interruption or cessation of streaming or monitoring services;
  • Any other matter relating to the Service.

OUR TOTAL AGGREGATE LIABILITY FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THIS AGREEMENT OR THE SERVICE SHALL NOT EXCEED THE AMOUNTS PAID BY YOU TO US DURING THE TWELVE (12) MONTHS PRECEDING THE CLAIM.

15. Indemnification

You agree to indemnify, defend, and hold harmless MyLinkLine Communications and its officers, directors, employees, agents, and affiliates from and against any and all claims, damages, losses, costs, and expenses (including reasonable attorneys' fees) arising from or related to:

  • Your use of the Service;
  • Your violation of this Agreement;
  • Your violation of any rights of another party;
  • Your violation of any applicable law or regulation;
  • Content you submit or transmit through the Service.

16. Termination

We may terminate or suspend your access to the Service immediately, without prior notice or liability, for any reason, including if you breach this Agreement. Upon termination:

  • Your right to use the Service will immediately cease;
  • We may delete your account and associated data in accordance with our data retention policies;
  • All provisions of this Agreement that by their nature should survive termination shall survive, including ownership provisions, warranty disclaimers, indemnity, and limitations of liability.

17. Governing Law and Dispute Resolution

This Agreement shall be governed by and construed in accordance with the laws of the State of Utah, without regard to its conflict of law provisions. Any dispute arising out of or relating to this Agreement or the Service shall be resolved exclusively in the state or federal courts located in the State of Utah, and you consent to the personal jurisdiction of such courts.

18. Changes to This Agreement

We reserve the right to modify this Agreement at any time. If we make material changes, we will notify you by posting the updated Agreement on this page and updating the "Last Updated" date. Your continued use of the Service after any changes constitutes your acceptance of the modified Agreement. We encourage you to review this Agreement periodically.

19. Severability

If any provision of this Agreement is held to be invalid or unenforceable, the remaining provisions shall continue in full force and effect. The invalid or unenforceable provision shall be modified to the minimum extent necessary to make it valid and enforceable.

20. Entire Agreement

This Agreement, together with our Privacy Policy and any separate service agreements, constitutes the entire agreement between you and MyLinkLine Communications regarding the Service and supersedes all prior agreements, understandings, and communications, whether written or oral.
